The website located at billgenix.com (the "Site"), and the Billgenix platform made available through it, are owned and operated by Billgenix, Inc. ("Billgenix," "we," "our," or "us"). The Site and platform are intended for use by healthcare providers, medical billing companies, lien firms, management services organizations, and revenue cycle management teams operating in the California workers' compensation space ("you" or "your").
These Terms of Use govern your access to and use of the Site and form a binding agreement between you and Billgenix. By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree, please do not access or use the Site.
The Site is provided as an informational and marketing resource to help visitors learn about the Billgenix platform, including patient and case operations, billing and EDI, collections and accounts receivable management, compliance and California workers' compensation tracking, dashboards and analytics, and personal injury revenue cycle modules, and to request a demo.
The Site is not itself the Billgenix platform. Access to and use of the platform, including any processing of protected health information or workers' compensation claims data, is governed by a separate signed Service Agreement, order form, and, where applicable, a Business Associate Agreement between you and Billgenix, and not by these Terms of Use alone.
You must be at least 18 years old to use the Site. If you are using the Site on behalf of a company, practice, firm, or other organization, you represent that you have the authority to bind that organization to these Terms of Use.
Our Privacy Policy, available at billgenix.com/privacy-policy, describes how we collect, use, and disclose information through the Site, and describes at a general level how healthcare and workers' compensation data is handled through the platform. The Privacy Policy is incorporated into and forms part of these Terms of Use.
You agree to use the Site only for lawful purposes and to provide accurate, current, and complete information when submitting any form on the Site, including your demo request. You agree to notify us immediately at [email protected] of any unauthorized use of the Site that you become aware of. You are solely responsible for ensuring that your use of the Site complies with these Terms of Use and all applicable laws, including applicable California workers' compensation law.
Requests for a demo are reviewed before scheduling. The Billgenix platform is intended for healthcare providers, billing companies, lien firms, and revenue cycle teams genuinely evaluating or operating California workers' compensation billing workflows. Billgenix reserves the right to decline any demo request or account application in its discretion.
The Billgenix platform is designed to work alongside your existing billing software and electronic health record systems, and does not replace them. The platform provides operational visibility, workflow, and compliance tracking tools; it does not provide legal advice, and lien preparation features are administrative aids, not a substitute for review by qualified legal counsel before filing. You remain responsible for the accuracy of data entered into the platform and for compliance with all applicable billing, coding, and California workers' compensation requirements.
All content on the Site, including text, graphics, logos, the Billgenix name and marks, images, videos, blog articles, and the design, arrangement, and selection of that content (collectively, the "Content"), is owned by or licensed to Billgenix and is protected under United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to view the Content for your own personal or internal business informational purposes. You may not reproduce, distribute, modify, publicly display, republish, or otherwise exploit any Content without our prior written permission. The Billgenix name and logo may not be used in any advertising, publicity, or promotional material without our express prior written consent.
Content published on the Site, including blog articles, resource materials, and reported metrics such as AR aging reduction or missed deadline reduction figures, is provided for general informational purposes only and reflects reported outcomes for individual organizations. Actual results vary based on claim mix, staffing, and existing workflow. Site content does not constitute legal, medical, billing, or compliance advice, and should not be relied upon as a substitute for review by a qualified attorney, certified coder, or compliance professional familiar with your specific circumstances.
When you submit information through a form on the Site, such as your name, contact details, or a description of your organization's billing operation, you represent that the information is accurate and that you have the right to share it with us. By submitting this information, you grant Billgenix the right to use it to respond to your inquiry, evaluate your demo request, and, where you have consented, send you marketing communications, in each case consistent with our Privacy Policy. Do not submit protected health information or workers' compensation claims data through the public marketing Site; such data should only be submitted through the authenticated Billgenix platform under an applicable service agreement.

By providing your email address and opting in through a form on the Site, you consent to receive marketing and product communications from Billgenix related to platform updates and workers' compensation revenue operations content. You may opt out of marketing communications at any time using the unsubscribe link included in each communication. Opting out of marketing communications will not affect our ability to respond to a demo request or an active account relationship. We do not sell your contact information to third parties for unrelated marketing purposes.
The Site may contain links to third-party websites and platforms, including our social media pages, and the platform may connect to external systems such as clearinghouses or payer portals that you authorize. Billgenix does not control and is not responsible for the content, accuracy, or privacy practices of these third-party sites and systems, and their inclusion does not imply endorsement by Billgenix.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. BILLGENIX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING ON THE SITE CONSTITUTES A GUARANTEE OF CLAIM ACCEPTANCE, REIMBURSEMENT OUTCOMES, OR COMPLIANCE WITH ANY SPECIFIC DEADLINE OR REGULATION.
TO THE FULLEST EXTENT PERMITTED BY LAW, BILLGENIX AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation does not apply to obligations set out in a separate written Service Agreement or Business Associate Agreement between Billgenix and a customer, which will govern liability with respect to the platform and any protected health information or workers' compensation claims data processed under that agreement.
You agree to defend, indemnify, and hold harmless Billgenix and its owners, officers, employees, and agents from any claims, damages, liabilities, and reasonable legal fees arising out of your violation of these Terms of Use or your misuse of the Site.
Billgenix may restrict, suspend, or terminate your access to all or part of the Site at any time, with or without notice and with or without cause, including where we believe you have violated these Terms of Use.
These Terms of Use are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms of Use or your use of the Site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. This Section does not limit any requirement under California law that cannot be waived by contract for California based customers.
We may update these Terms of Use from time to time by posting a revised version on the Site with an updated "Effective Date." You are responsible for periodically reviewing these Terms of Use. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms of Use.
If any provision of these Terms of Use is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Billgenix regarding your use of the Site. Our failure to enforce any provision of these Terms of Use shall not be considered a waiver of that provision. These Terms of Use do not create any rights or remedies for any third party.
